| Terms Of Contract The contract is effective on the first day following the expiry of the free warranty period or the date of the previous contract, and shall remain in force for a period of one (1) year from such date unless a multiple year contract is in force. This contract may be terminated with a thirty (30) day written notice by either party. The CUSTOMER agrees that until this contract has been duly terminated by either party, they shall not remove or transfer any of the equipment from the location. |
| Exclusions Service required to move the equipment from one location to another. Accessories or devices not described in your contract. Service required for, or as a result of, modifications and/or system changes not endorsed by Medilink’s Suppliers. Expendable supply items such as, but not limited to, electrodes, lead wires, recording paper, non user replaceable batteries, patient cables, ink, powercords, telephone cords or labour and mileage or expenses incurred to maintain these items. Necessary repairs and replacement parts resulting from faulty devices connected to equipment not referenced in your contract. Repairs resulting from any misuse or abuse of the equipment by the operator. |
| Conditions The CUSTOMER agrees to co-operate in the use of the equipment, to notify Medilink promptly in the event of any irregularity in the operation of said equipment, and agrees not to permit anyone to perform service work upon same unless authorised to do so by Medilink. Medilink shall not be responsible for replacement of parts or the furnishing of labour necessary as a result of civil insurrection. Flood, fire or other Acts of God. Misuse or intentional damage or malfunction caused by any repair or maintenance of equipment by person(s) employed by the Hospital/Health/Authority/Institution or any other person(s) obtaining access to the equipment. |
| Contract Charge The contract charge covers all costs of maintenance, repairs and periodic preventive maintenance and safety inspections, (dependant upon option taken) as detailed in the Contract Specification (copies available on request) with the exception of those listed within the exclusions. |
